A class-action lawsuit against MoviePass competitor Sinemia from angry subscribers is heating up

  • An amended complaint in a class-action lawsuit against MoviePass competitor Sinemia was filed this week.
  • The lawsuit, initially filed in November, alleges that the movie-ticket subscription service has “essentially become a bait-and-switch scheme” because of a new fee.
  • The amended complaint added plaintiffs and brought the number of US states represented from two to 10.
  • “While nobody enjoys fees, there are certain costs related to booking and processing outside of the price of the movie ticket,” Sinemia said in a statement to Business Insider about the lawsuit.

The class-action lawsuit against MoviePass competitor Sinemia is heating up.

On Monday, the law firm Chimicles Schwartz Kriner & Donaldson-Smith LLP filed an amended complaint in Delaware, adding how many additional plaintiffs, bringing the total from 2 to 11 across 10 US states (as well as “all others similarly situated”).

The lawsuit, which was initially filed in November, alleges that the movie-ticket subscription service has “essentially become a bait-and-switch scheme” because of a new fee.

Sinemia had previously challenged the suit on jurisdictional grounds, which is part of the reason the amended complaint added plaintiffs to bring the number of US states represented from two to 10.

“We are looking forward to having our day in court and feel very strongly that we have a compelling story to tell,” Benjamin F. Johns, a partner at the plaintiffs’ firm, told Business Insider.

“The ball is now in Sinemia’s court to respond,” he said.

‘While nobody enjoys fees…’

The crux of the suit is a $1.80 per-movie “processing fee” introduced by Sinemia in October to subscribers, including those who had prepaid for a yearly subscription. The suit argues that the new fee “dramatically changes the value proposition that customers thought they were getting.”

The suit claims Sinemia’s conduct includes “fraud, breaches of contract, violations of state consumer protection laws, and unjust enrichment.”

“While nobody enjoys fees, there are certain costs related to booking and processing outside of the price of the movie ticket,” Sinemia said in a statement to Business Insider in response to the amended lawsuit. “As our customers are already aware, the processing fee is a requisite part of Sinemia subscriptions. This allows Sinemia to maintain being the only movie ticket subscription service to provide access to all showtimes for all movies in all theaters without restrictions.”

While Sinemia discloses its fees in its terms, the suit includes examples of the company’s marketing that mentions the concept of “one low monthly cost.” As Business Insider previously reported, there are seven ways Sinemia can charge customers fees.

A new debit card

In Sinemia’s statement to Business Insider, the company stated that customers could avoid processing fees by using a Sinemia debit card. This debit card became available by request starting at the end of November, and costs customers $14.99 to order.

Since November, Business Insider has been contacted by over 200 customers who expressed anger about various aspects of Sinemia.

In addition to the processing fee, Sinemia customers have complained about being charged “misuse” fees for failing to check in (which many blamed on glitches in the app that Sinemia has denied can happen) and Sinemia’s demands for two forms of ID to verify accounts, among other issues.

First-term senator John Kennedy (R-LA) on Saturday night poked fun at the Trump administration during an appearance at the Gridiron Club and Foundation dinner, a gathering of top government officials and elite media figures.

Kennedy, who spearheaded a bill to prohibit airlines from storing animals in overhead bins, went all in last night with jokes about the White House, climate change, Ivanka Trump and even Jussie Smollett.

“I am nervous as a pregnant nun. My name is John Kennedy, I’m a United States senator and I represent the people of Louisiana on cable news stations across this nation,” he began. “I’m told there are some print journalists here tonight. I know they’ve been struggling as a business. I’m from the government. I’m here to help you.”

“Y’all ought to consider applying for a job at the White House. They’ve got lots of openings. Just tell them that climate change is more fake than a Jussie Smollett assault and you’d date Ivanka too if you could,” the senator quipped. “I’m pretty sure that joke screams national emergency.”

Kennedy then fell back on a self-deprecating joke about his state, Louisiana. “In all seriousness, I love newspapers. I read several every day. I bet that surprises you. We made learning to read mandatory in Louisiana about 10 years ago.”

“Best thing we ever did. We can read billboards. We can read the backs of cereal boxes. It’s great,” he added. “And just for the record, hell yes, we have electricity, unlike Alabama. Our rival, our arch rival. Did you know why Alabama raised the drinking age to 32? They wanted to keep alcohol out of the high schools. Please don’t tell Shelby I said that.”

After Trump’s last-minute cancellation of his scheduled appearance at the annual dinner following his two-hour-long address at the Conservative Political Action Conference (CPAC) in Maryland, his daughter and senior adviser Ivanka Trump went in his place. Presidential candidate Sen. Amy Klobuchar (D-MN) was also featured at the event this year.

During her speech, Ivanka Trump ridiculed the Green New Deal and joked that “being Donald Trump’s daughter” is the “hardest job in the world.”

“When my father asked me just this afternoon to represent him tonight — no, this isn’t a joke — to represent him tonight, I didn’t have time to write any jokes. I feared that the funniest thing I could do was read you excerpts from the Green New Deal,” she said. “The press seems to think it’s ironic that I, born of great privilege, think people want to work for what they are given. As if being Donald Trump’s daughter isn’t the hardest job in the world.”

Ivanka Trump joked about having “the hardest job in the world” at an appearance at the Gridiron Club dinner on Saturday, a highly exclusive annual gathering of Washington politicians, journalists, and media power players.

The 134-year-old tradition features a white-tie dinner and is more of a socializing and networking opportunity peppered with self-deprecating speeches than anything else. 2020 Democratic hopeful Amy Klobuchar‌, amid reports that she treats her staff like dog crap, joked about eating her salad with a comb.

(“How did everyone like the salad?” Klobuchar asked, referencing reports that she’d once aggressive-aggressively eaten a salad with a comb and then told an aide to clean it after the staffer had forgotten to bring her a fork. “I thought it was OK, but it needed just a little scalp oil and a pinch of dandruff.”)

But things really heated up when Ivanka Trump stepped in for dear old dad. The First Daughter said she  “didn’t have time to write any jokes” because her dad had asked her to replace him last-minute, “So I figured the funniest thing I could do is read you excerpts from the Green New Deal.”

Trump is, of course, referencing the progressive environmental proposal spearheaded in part by Rep. Alexandria Ocasio-Cortez; the two had just got into a Twitter spat over the GND last week.

She then brought out the crown jewel of self-deprecating knee-slappers: “The press seems to think that it’s ironic that I, born of great privilege, think that people want to work for what they are given,” Ivanka Trump said. “As if being Donald Trump’s daughter isn’t the hardest job in the world.”

Twitter had thoughts about this particular joke of Ivanka’s. While having to constantly fend off your father’s sexual advances is certainly no easy task, it’s still difficult to feel bad for someone who’s literally never had to hold down a job.

John Oliver Roasts Ivanka Trump and Jared Kushner: You’ve Accomplished Nothing Based on ‘Merit’

John Oliver went after White House advisers Ivanka Trump and Jared Kushner over their security clearance controversy on Sunday’s episode of Last Week Tonight.

Setting Oliver off was a New York Times report last week that found President Donald Trump ordered former chief of staff John Kelly to give Kushner, his son-in-law, top-secret security clearance, against the advice of officials and a White House lawyer.

“Jared is exactly where you’d expect a boy his age to be,” Oliver started, noting the 38-year-old’s responsibility to resolve the Israel-Palestine conflict: “Trying to broker a peace deal in one of the most intractable conflicts in geopolitical history.”

“One major issue with Jared having access to state secrets is, you know, it’s Jared. A guy who, even among Jareds, stands out as the Jared of the group,” Oliver joked. “But the other issue with his top secret clearance concerns national security,” he continued, referencing a Washington Post report that officials from multiple foreign countries saw Kushner as “exploitable.”

Oliver made sure to go off on a diatribe about Kushner’s appearance, calling him a “17th Century portrait of a Dutch teenager.”

The Comedy Central host pointed out that administration officials have repeatedly denied Trump interfered with the security process, including Ivanka Trump, who in an interview with ABC said the president had no involvement in her and Kushner’s clearances.

“Oh, please,” said Oliver. “I honestly don’t know what’s sadder there: either Ivanka is knowingly lying about her Dad forcing her and Jared’s security clearance through, or she genuinely thinks they got it on merit on their own. And if it is the latter Ivanka, there are some things that you really should know.”

“You only became an executive vice president of the Trump Organization at 24 because you’re Donald Trump’s daughter, not because you are a 24-year-old business prodigy. You only got a book deal because you’re Donald Trump’s daughter, not because you’re a brilliant author and wordsmith. And you only hosted the Miss Teen USA pageant because your Dad owned the contest, not for your sparkling on camera presence.”

Alexandria Ocasio-Cortez fired back at Ivanka Trump over her criticism of the ‘Green New Deal’ and its false promises of guaranteed jobs and good wages.

The Democratic socialist’s plan includes a promise to provide “a job with a family-sustaining wage, family and medical leave, vacations, and retirement security” along with “economic security for all who are unable or unwilling to work.”

The First Daughter took umbrage with the notion that Americans prefer handouts as opposed to earning their way through life.

“I don’t think most Americans, in their heart, want to be given something, she countered.  “I’ve spent a lot of time traveling around this country over the last 4 years. People want to work for what they get.”

She pinpointed the criticism even further in a follow-up tweet, saying “I do not … believe in a minimum guarantee for people ‘unwilling to work.’”

And while the daughter of a rich entrepreneur might not be the ideal vessel for such a message, Ivanka isn’t wrong by any stretch.

Ocasio-Cortez Fires Back

Ocasio-Cortex, however, as in most cases, seemed rather confused about the notion of working for what you earn.

Imagine attacking a Jobs Guarantee by saying ‘people prefer to earn money.’

Imagine that!

Ocasio-Cortez would also argue that a minimum wage is a right that should be afforded all people, even apparently those unwilling to work.

“A living wage isn’t a gift, it’s a right,” she said, citing her career as a bartender. “Workers are often paid far less than the value they create.”

The second half of that statement may be true in some cases, but certainly not all. The first half of that statement is such a ridiculous concept that only someone with a $93 trillion plan to save the world within 12 years could possibly find it truthful.

“A living wage isn’t a gift, it’s a right.”

Ivanka Reminds Her That Jobs Market Is Pretty Good

Ocasio-Cortez’ fascination with burdening the economy by providing guaranteed jobs seems slightly misguided considering the market is humming along like a fine-tuned machine.

“I think fundamentally if you ask yourself the question, ‘are we better today than we were yesterday or we were 2 years ago?’ The answer is, undoubtedly, yes,” Ivanka said.

Things are, by nearly every measure, better for people actually willing to work. The New York Democrat represents those who want free handouts. Which group is more representative of American’s hard work and ingenuity?

Perhaps that’s why she’s so confused. She can only relate to people that want things handed to them.

John Cena has officially reached a record with his work for Make-A-Wish. He has fulfilled dreams for 580 kids. That is more than any other celebrity in history! The most interesting part is that his first wish granted for Make-A-Wish was actually an accident. We bet you didn’t know that!

John Cena is a WWE superstar and now an actor. Turns out he is a really nice guy too! In 2004, he wasn’t very famous yet. He was pulled in to talk to one of the families from the Make-A-Wish Foundation. He described it as a life-changing experience and immediately wanted to grant more wishes.

Now Cena is the most requested celebrity by kids in the Make-A-Wish Foundation. While he has granted 580 wishes, no other celebrity has done more than 300. Cena says that every wish is just as fulfilling and amazing as his first accidental wish.

According to TODAY, Cena said, “They all stand out. The most important thing is making the experience special because it’s their wish. It’s a spectacular thing…When you give them happiness, they get an escape. You don’t know the power of hope. Hope can equate to time, and that’s absolutely priceless.”

He believes that kids love him because he never gives up, just like them. The kids in the Make-A-Wish Foundation program are generally battling life-threatening illnesses and start to maintain a “never give up” attitude. These same kids watch Cena in the ring, where he is often down but never out!

Cena said this is what connects him to the kids so much. He also said that it really gives him a new perspective. He said he thinks about when he gets sick and how grumpy he gets. Then he sees these kids battling something much worse and sees how positive and upbeat they are. He often tells the kids they inspire him more than he could ever inspire them.

His Latest Wish Granted

Cena starred in the new Transformers movie, “Bumblebee,” and recently invited 20 Make-A-Wish kids to an early screening of the film. What a nice guy! We hope to see John Cena continue to grant wishes for Make-A-Wish kids and their families.

It isn’t just the kids that love Cena. Make-A-Wish Foundation is really grateful for him as well. According to TODAY, Shaina Reeser, Make-A-Wish’s director of entertainment and sports relations said, “Every moment he spends with a wish child, he shows that child that the impossible is possible; that hope is powerful. Wishes can give children the strength to keep fighting — and that strength is what John provides with each wish to meet him he grants.”

Days after she was skewered for her critical comments on the living wage debate, Ivanka Trump made herself the punchline at a high-profile annual dinner Saturday night joking that being Donald’s daughter is “the hardest job in the world.”

Daily Beast reports:

Ivanka’s quips came during a speech at Washington D.C.’s Gridiron dinner, an annual “white-tie” fete for political journalists where featured speakers make themselves the punchline, according to NPR.

Trump told Gridiron attendees that she was appearing in her father’s stead and claimed he asked her to do so “just this afternoon.”

“No, this isn’t a joke,”she reportedly said.

The real estate heiress explained that she couldn’t write her jokes in time, “so I figured the funniest thing I could do was read excerpts from the Green New Deal,” poking fun at the agenda item championed by progressive Democrats including New York Congresswoman Alexandria Ocasio-Cortez.

Trump last week criticized the living wage component of the deal, during a Fox News interview: “I don’t think most Americans, in their heart, want to be given something. I’ve spent a lot of time traveling around this country over the last four years. People want to work for what they get.”

“So, I think that this idea of a guaranteed minimum is not something most people want. They want the ability to be able to secure a job. They want the ability to live in a country where’s there’s the potential for upward mobility.”

In light of the backlash she received, most notably insisting others work despite living a life of privilege, she joked, “as if being Donald Trump’s daughter isn’t the hardest job in the world.”

Trump was not alone in her self-deprecation.

Minnesota Democratic Sen. Amy Klobuchar, who is vying to become the party’s 2020 presidential candidate, was also among the speakers and for her part quipped about recent reports detailing her rough treatment of staff.

Klobuchar referred to one now-notorious allegation—that she ate a salad with a hair comb, and then demanded that the staffer clean it, per reports.

“How did everyone like the salad?” Klobuchar said at the dinner, according to Politico. “I thought it was OK, but it needed just a little more scalp oil and a pinch of dandruff.”

‘Indict Jared Kushner! Indict Ivanka Trump!’: MSNBC Guest Rips Trump’s Son-In-Law as ‘Massive National Security Risk’

Journalist and author Sarah Kendzior on Saturday slammed President Donald Trump’s son-in-law and senior adviser Jared Kushner as a “massive national security risk” and argued that he, and his wife Ivanka Trump, should be indicted.

During a segment on AM Joy, panelists discussed recent reports that revealed Trump ordered his former chief of staff John Kelly to grant Kushner a top-secret security clearance last year, against the objections of intelligence officials and the White House’s top lawyer.

“Basically, Trump has been grooming those two for a dynastic kleptocracy,” Kendzior, author of The View From Flyover Country, claimed. “This is very common. This is something you see in autocracies, this is something you see in mafia states, where the leader will put his children or relatives into office in order to keep the corruption going, keep the money flowing, not get caught, override prosecution.”

She added: “This is like the 12th time I’ve been on your show talking about Jared Kushner and the fact that he lied on his clearance forms, that he’s done illicit dealings, that he’s giving away state secrets and that he’s a massive national security risk. And so is Ivanka Trump.”

Kendzior then asserted that “the only way” to stop having these conversations about Kushner is “if he is indicted!”

“That is is what needs to be done. Because this problem is enormous. It’s going to persevere. Even if he is gone, he is carrying around this information, other people are carrying around classified information,” she continued. “They do not have loyalty to the country. They have debt. They have financial interests. They have personal interests.

“This problem needs to be handled now,” Kendzior declared. “Just indict Jared Kushner! Indict Ivanka Trump and get this crime family out of the White House!”

Senior administration officials found the president’s decision last May to be so troubling that Kelly penned a contemporaneous internal memo outlining how he was “ordered” to allow Kushner top-secret clearance, The New York Times reported on Thursday.

Then-White House counsel Don McGahn also wrote a similar internal memo detailing concerns raised about Kushner’s security clearance, including by the Central Intelligence Agency (CIA).

Although the Times didn’t specify the reason why officials were concerned over Kushner’s security clearance, some sources told the newspaper that White House officials believed it was too risky to share top secret information with a staffer who has multiple international business interests.

In January, congressional Democrats launched a wide-ranging inquiry into the security clearance of several current and former White House officials, including Kushner. But the House Oversight Committee Chairman Elijah Cummings said that in the five weeks since, the Trump administration “has stalled, equivocated and failed to produce a single document or witness to the Committee.”

Cummings penned a letter on Friday to White House Counsel Pat Cipollone where he demanded that the White House be in “full and immediate compliance.”

“If true, these new reports raise grave questions about what derogatory information career officials obtained about Mr. Kushner to recommend denying him access to our nation’s most sensitive secrets, why President Trump concealed his role in overruling that recommendation, why General Kelly and Mr. McGahn both felt compelled to document these actions, and why your office is continuing to withhold key documents and witnesses from this Committee,” Cummings wrote.

Trump’s eldest daughter-turned-White House senior advisor, Ivanka Trump, attempted to laugh off the criticism she received for saying most Americans wouldn’t necessarily want a guaranteed minimum income, reports HuffPost.

In brief remarks at the annual Gridiron dinner in Washington on Saturday night, a gathering hosted by journalists, Ivanka joked about her privilege she was born into as the daughter of President Donald Trump, calling it the “hardest job in the world.”

“The press seems to think it’s ironic that I, born of great privilege, think people want to work for what they are given,” she said, according to The Washington Post. “As if being Donald Trump’s daughter isn’t the hardest job in the world.”

In an interview with Fox News that aired last week, Ivanka criticized the proposed Green New Deal’s job guarantees initiative, which would increase the federal minimum wage and guarantee jobs to everyone in the U.S.

“I spent a lot of time traveling around this country, over the last four years, people want to work for what they get,” she told Fox News.

In her remarks Saturday night, Ivanka acknowledged her father’s absence from the dinner.

“The opportunity to poke fun at the media is not something he passes up lightly,” she said, adding that for her father ― who regularly criticizes the media on Twitter ― “every day is a Gridiron dinner.”

At a White House business session on Monday, President Trump told the nation’s governors that his daughter Ivanka had “created millions of jobs,” although he did not provide any details.

“My daughter, Ivanka, who is going to be speaking later, is—she has been so much involved. So incredibly involved,” Trump said at the White House.

“Where is Ivanka? Ivanka, keep going. My daughter has created millions of jobs. I don’t know if anyone knows that, but she’s created millions of jobs,” he added.

The president did not explain exactly how he believed his daughter, who he made a senior White House adviser, had been directly responsible for millions of jobs.

John Oliver Slams Ivanka Trump and White House Nepotism: You’re Donald Trump’s Daughter, Not a Business Prodigy

John Oliver skewered Jared Kushner and Ivanka Trump on Sunday’s episode of Last Week Tonight. Taking aim at the couple’s relative lack of political experience, he blasted their White House positions and security clearance as examples of nepotism.

Nicknaming Kushner “Diminutive Nothing Boy 1,” in reference to the ongoing Mueller probe into alleged collusion with Russia, Oliver took a swipe at the youthful senior advisor’s diplomatic work in the Middle East.

Jared is right where you would expect a boy of his age to be. Trying to broker a peace deal in one of the most intractable conflicts in recent geopolitical history,” the comedian said.

Oliver speculated that Kushner maintains his relaxed, “radiant” appearance in spite of his role because he simply doesn’t understand the complexities of the mammoth “to-do list” his diplomatic commitments entail.

Although the senior aide looks like “a 17th century portrait of a Dutch teenager,” Oliver said the stress he is surely under should give him the wrinkles of late former secretary of state Warren Christopher, who served in President Bill Clinton’s cabinet back in the mid-1990s.

Oliver did, however, praise Kushner’s ability to to navigate the “psychosexual Stalingrad that is marriage to Donald Trump’s daughter.”

Moving on to Ivanka, the comedian laid bare his views on nepotism in the White House. Targeting Trump’s recent declaration on The View that her father had “no involvement” in her and Kushner’s controversial security clearance, Oliver said she was either lying or genuinely believed the pair were deserving of the privilege.

Her statement contradicts a recent report in The New York Times that claims her father ordered his former chief of staff, John Kelly, to grant Kushner “a top-secret clearance” back in 2019. Kelly and former White House counsel Don McGahn both reportedly stated their concerns about the move in internal memos.

If Ivanka truly believes she and her husband achieved their clearances on their own merit, Oliver said, “there are some things that [she] really should know.”
